§ 14-1108. PARKING OF COMMERCIAL VEHICLES.

  • (a) Except as provided in Subsection (c) below, no person shall park a commercial vehicle with a manufacturer's gross vehicle rating of 10,000 pounds or more on any street in any Residential District as defined in Section 12-105-R of this Code.

    (b) Notwithstanding subsection (a), no commercial vehicle with a manufacturer's gross vehicle rating of 10,000 pounds or more shall park on any street between the hours of 2:00 a.m. and 6:00 a.m. except on those streets located in the following zone districts:

    (1) M-1P (Industrial Park Manufacturing) as defined in Section 12-225 of this Code.

    (2) M-1 (Light Manufacturing District) as defined in Section 12-226 of this Code.

    (3) M-2 (General Manufacturing District) as defined in Section 12-227 of this Code, and

    (4) M-3 (Heavy Industrial District) as defined in Section 12-228 of this Code.

    (c) Subsections (a) and (b) above shall not be effective with respect to any commercial vehicle making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on any street as specified in Subsections (a) and (b) or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure located on any street as specified in Subsections (a) and (b) for which a building permit has previously been obtained. Subsections (a) and (b) above shall not be effective with respect to police, fire, sheriff, ambulance, or highway patrol emergency vehicles or tow trucks owned and operated by an individual or business included on any law enforcement tow rotation list and subject to call for service during the hours of 2:00 a.m. and 6:00 a.m.

    (d) Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this ordinance is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this ordinance. The Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases are declared unconstitutional, invalid, or ineffective.
